I totally understand "gifts" to public employees. I was a school superintendent and if I went out to eat with a salesman or someone else doing business with the district, I had to pay or we had to get separate checks. Same when I was an auditor for the Texas Education Agency.
But NIL isn't supposed to be "gifts". They are supposed to actually do something for the payment unless I'm totally mistaken.
I could see this getting "touchy" but this is another example of why there needs to be some regulation and clarification. JMO
