Johnny Hockey dead after being hit by a car

Some interesting facts...

The driver’s blood alcohol concentration was listed as being 0.087% — just over the legal limit, court papers state.

Tests also showed Johnny’s blood alcohol concentration level was 0.129% when he was killed, while his brother had a reading of 0.134%, according to the filing cited by the outlet.

Higgins’ attorney did not argue in the new filing that the Gaudreau brothers’ blood alcohol levels played any role in the crash, according to NJ.com.
The court papers also don’t allege the brothers were breaking the law at the time.

Riding a bicycle while intoxicated in the Garden State will not result in a DWI — or Driving While Intoxicated — charge because a bicycle is not considered a motor vehicle under state law. However, riding a bike while drunk could result in a charge of disorderly conduct, according to the Kugel Law Firm, which specializes in DWI cases in New Jersey and New York.

Instead, the filing asks for additional information on how the readings were collected — as his defense team plans to ask a judge to dismiss the indictment leveled against him, the outlet reported.
The Gaudreau brothers were undoubtedly celebrating the imminent wedding of their sister. Unlike the majority of our slothy society who would've sat they're fat asses in front of a television that evening, the Gaudreau brothers were finely-tuned athletes who needed to exercise at that time.

I wish common sense like this prevailed in these types of situations instead of scumbags trying to manipulate legal technicalities to get away with manslaughter.

I agree that them

you think they were out exercising? while hammered? lol

They were riding bicycles on country roads. What, do you think their purpose was, to pick up chicks? "Hey girl, hop on my handlebars and I'll bike you to my clubhouse so we can play Truth or Dare."

or they wanted to go for a drunk bike ride to get from point A to point B.

The accident happened after 8pm, so close to dusk but still light out. The articles don't mention what kind of bikes they were on, but I highly doubt they had their spandex on so they could get their heart rates up.

Not sure what this means legally, but this POS better not slither out of serving a long sentence

There are a lot of details to come out before anyone can make a decision. One thing to consider is the guys on the bikes were not driving a 3000 pound machine that can kill people. I don't think he gets out of this scott free.

But if they were hammered and swerved into him, what the hell? It's not the driver of the cars fault if drunk people cause their own accident.

I would imagine they purposely road their bikes instead of a car knowing they were going to get hammered. If the perentages are right ... a .129 and a .134 ... they carry responsibility in this as well.

Based on the witnesses, this doesn't seem like the scenario that happened

But if they were hammered and swerved into him
That point would carry more weight if the driver of the car didn't wipe out both of them at once.

One bike swerving into a vehicle?

Two bikes swerving into him at the same time?

sounds like they were riding on the shoulder and the guy driving the truck got pissed at the car in front of him for not letting him pass on the left...so he went to the right of them and hit the brothers. The car being passed was riding in the middle of the road so not to hit the bicyclers

.13 is far from hammered.

Yea, this one seems to be a pretty slam dunk case given that the whole thing happened because the asshole passed a potential witness in his car.
