In his "notice of opposition," Jackson's legal team argues he is "well-known by this number due to his notoriety and fame," and that granting Earnhardt's trademark would create a situation where consumers could erroneously buy an Earnhardt shirt when they meant to purchase a Jackson shirt

It's not the first time Jackson tried to stop another athlete from filing a trademark for the number. Jackson and Troy Aikman — who also wore No. 8 during his NFL career — are still engaged in a legal battle over the number.

Who wants to be the one to tell him there’s another even more famous #8 — in his backyard no less, who’s about to set a huge sports record, possibly as soon as this weekend? :LOL:

well the ironic part it was Dale Jr. that lost his right to use #8 the way he wanted when his dad was the one that started the whole trademark # thing with the #3.

Teresa sued Dale Sr’s other son, Kerry for starting a business that had nothing to do with racing that had his own last name in it. I can’t think of a bigger bitch that isn’t a politician

Is he really more famous? I mean he's better at his sport but I'm not sure an NHL player would be more famous, at least not in the country where the trademark is for.

Ask a casual hockey fan in 15 years who has the most goals, they'll know who Ovechkin is. As someone outside of Baltimore or Louisville who Lamar Jackson is, it's a good bet they don't know who you're even talking about. No one remembers Pro Bowlers, even MVPs if they don't win Super Bowls or aren't media personalities.

People will remember Gordie Howe for ages. Guys like Jay Cutler, Johnny Manziel and Robert Griffin III are barely a memory.
