Absolutely. High risk job with very few willing workers and lots of turnover. You’re gonna pay 💰 to have those suckers cut down, especially when you’re only option is having it fall in your (or your neighbors) home.
but what if you're just, fuck it, i shook your hand, i'm sure you're insured, quoted me a fair price, and you just did the job discount?

There are plenty of people willing to do it, but it definitely costs. I don't think my neighbor wants to pay someone...so if he does it himself and fucks it up, insurance won't cover it...so he is hoping it falls safely...which makes me uncomfortable because of the way it is leaning.

I can't pay someone to come cut down a tree on his property...

if cost is his issue I’m sure he will allow you to pay to have it cut down. He may even split it with you

I didn’t read through it yet but maybe some good info for you.

edit: A quick glance tells me laws on these things differ from state to state and you should check your HO policy.

 
Generally speaking if there was any reason to believe the tree would fall then your neighbors would have a responsibility to mitigate the hazard. This means that if the tree was sick or there was existing damage or something then your neighbor should have cut the tree down before it had a chance to fall. If this is the case then they are most likely liable and their insurance should pay out for the damage. If the tree was healthy and there wasn't a reason to believe it would fall then most likely your insurance will pay out and you will have to cover the amount of your deductible out of pocket.
 
@ill you might want to verify the laws in your area then share it w your neighbor. Ask him if he wants to pay now to cut the tree or pay more forever when his insurance premiums sky rocket after they are forced to build you a new house.

I plan on calling my insurance provider tomorrow, find out my options there.

If an owner has notice that their tree is damaged and is likely to fall or otherwise damage a neighbor's property, then that owner has a duty to take appropriate steps to ensure that the neighbor's property is protected. If the owner breaches this duty, then they may be subject to liability.

yeah… that’s why I told you to send him the letter I described in my previous post. (See post 54)

FWIW, I’m not sure I’d call your insurance company. You may see a spike in your premium because they now know of the additional risk.
 
Does any part of the tree overhang your property?

Id “put them on notice” with a letter. (Ie IMO you’re tree is dead and may fall over causing harm to my property. Please take steps to ensure that doesn’t happen)

lastly, make sure your homeowners insurance coverage limits are high enough to cover and damage

And you are correct, a letter seems necessary. Do I need to go through a notary or anything?

no. A notary just says you’re the actual person who signed it. I’d say a letter is fine. You MAY consider certified mail (that proves he signed for it) but they may be a little over the top. Maybe just hand it to him and say “sorry. My insurance company advised me to give this to you.”

yea, I don't want to be a dick about it

someone on tHoop is saying I should pitch in in having it cut down, which is just silly...it's not my tree!
