I say technically because OP said he was being sued for a sum certain ($35,000). If that is within his policy limit then there is no risk of an excess verdict and there’s no incentive for the carrier to acquiesce to a policy limit demand.

Personally I renew with existing company and let this ride for awhile and you can switch companies at any point.
