I've told this story before, but it applies to your dumb ass. I was defending a case against a pro se plaintiff, and he brought some motion where he cobbled together a bunch of words that sounded important, but at the end of the day made no sense. I wrote a reply brief that simply said something like, "We have attempted to understand what the Plaintiff's motion is, but are not capable of understanding or replying to it. There are no cogent points being made, and we have no idea what relief is being sought." At the hearing, he got up and said a lot of legal words that together made no sense. When he say down, the judge looked to me and I stood up, shrugged my shoulders and said, "your honor, I have nothing. I have no idea what he just said. But I will state for the record that whatever he said, we adamantly oppose it. Thank you." The judge and everyone else in the courtroom laughed. She then looked over at the poor fool and said, "motion denied, next case."

Truly, that moron could have been you. You are saying all sorts of fancy words that together don't express a single cogent idea. Put down the knife WebAttorney, you are so far in over your head you are drowning.

If Texas says fuck off and the State Government sides with them, it is game over. Fox is not going to risk pissing off millions of people in Texas that root for the Longhorn and lose more face in it...

Granted that is a probably unrealistic nuclear route but if I am the President of the University of Texas, I am at least throwing it out there. I could instruct my accounts payable to pay out a check I think is fair and ignore any other requests. What are they going to do? Arrest me? Arrest the Accounts Receivable team? How can a court in Delaware actually force a school to make a payment to Fox?

This guy understands and gave an example. You cannot ENFORCE a contract against a Government Entity if the Legislature and Governor (i.e. Executive and Legislative branch) are behind them. There is multiple precedence with Court Decisions being ignored by Government Agencies. So the University of Texas at Austin can literally say FUCK YOU to GOR and Delaware and not pay and there is nothing out there that could enforce the University of Texas to pay it without support from Texas Government.

Basically if I am the President of Texas and I told everyone the following:

"We are going to the SEC in 2023 and we are not paying a dime. I will instruct my Accounting to not pay any of you."

There is literally fucking nothing the Big12 or Fox could do short of petitioning the Texas Legislature or Governor to act against the University. There is no method that can literally enforce Texas to pay them.

That is the DIFFERENCE between a private party entering a contract and a public (government owned) agency. The Government can breach contracts and you have little recourse to get payment.

Sure it would be controversial as hell to do that but it literally can happen.

If the Texas Legislature agreed that Texas should go to the SEC and not pay a dime to the Big12 and Fox, your GOR and all that shit would be out of luck. There is nothing anyone could do short of maybe Biden to force the University of Texas to pay a dime. This is the difference between a private and public institution. Baylor, for example, would have little recourse and could face losing accreditation if they didn't pay or bankruptcy. Texas takes instructions from the State of Texas as a public institute and can totally walk away and breach a contract of the Texas government supports it.
 
Also @WhosYourDawggy is 100% correct on forum. You would be correct if Oklahoma and Texas were Delaware companies but since they are public institutions and possibly defendants, they can totally have the case on Texas or Oklahoma.
 
I'm not a lawyer and I'm genuinely curious about this. If Texas or Oklahoma could simply leave their contract, why wouldn't they leave the Big 12 now? Do they feel like it would hurt their future contract negotiations if they fail to fulfill these?

I feel like it wouldn't be that simple but this is admittedly not my area of expertise.

They don't have the political backing and I also think all parties are somewhat sincere here. I also don't think that OU, the SEC, or Texas wanted it to happen as quick. Quitting a contract is a nuclear route and very controversial but in theory they could do it if they had the Political backing. Heck Legislatures have force teams to play each other, see Florida and FSU rivalry.

Also it sounds like this deal is closer that people believe. Big12, to be frank, has been very fair to OU and Texas on a variety of items.

Also talks about the money part.. and how usually a school will pay 60% of whatever money is owed..because they don't want to go through the courts route.. 60% of $84 million is still $50 million each from TX/OU. That's a considerable haircut for any athletic department.

Note he also said "Where does it go to court, what state". He knows Delaware is likely.

yeah listen to the whole clip.. lol why are you putting words in his mouth for? He didn't say Delaware.. Cause like the other guys said in here.. UT and ou could fight this and get it heard somewhere else..

But luckily they nor the Big12 are bent trying to screw each other up in "hopes" of getting every penny. He said he feels the Big12 will feel good about it as will the other parties.
