In the end the responsibility falls to the cyclist. Sure with this video the biker could go to the police and the driver would get a failure to signal ticket. The biker would get a failure to maintain safe distance ticket.
But...the cyclist is the one that has to anticipate the bad driving of all those around him. Same as motorcycle drivers and even car drivers. Can't even count the number of accidents I've avoided because <knock on wood> I was paying attention to my surroundings and avoided the bad drivers. There are a lot of cyclists in the cemetery who were completely in the right. Think "right of way" matters to them?
Yep. One of the first things I learned from Drivers Ed at school and from my dad was to be a "Defensive Driver". Always try to anticipate what other drivers are going to do.
I've had two accidents in 46 years of driving.
One was 32 years ago and that was because the other driver ran a red light and T-boned me.
The other driver was deaf. He was looking at his passenger who was communicating with him via sign language. I was first car out into the intersection on a green arrow thought to myself "Shit he's not paying attention and not gonna stop".
The guy in the passenger seat pointed up at the light to the driver, but it was too late.
The 2nd one was just last year in Omaha. Younger guy (early - mid 20's) rear-ended me when I was stopped at a red light. He was hauling ass and his skid marks were only about 4 ft long so he blasted me pretty good.
He claims the sun was in his eyes (possible as it was early evening and setting). However, most people think he was looking at his phone.
