In the world of contracts he could still be working under the terms of his old one and then in any new contract have make-good pay. It's risky as hell because at any time either could be poached or just say fuck it and walk away. Doing a job you aren't under contract to likely wouldn't hold up in court. The school also isn't like to screw over a coach if they ever hope to get another.
